PUBLIC NOTICE The Board of Zoning Appeals of the City of Falls Church, Virginia will hold a public hearing on March 17, 2011 at 7:30 p.m. in the Council Chambers, 300 Park Avenue, for consideration of the following subjects: A. Appeal Application A1522-11 (MUNIS #20110052) by Daniel K. and Kim Maller, appealing the Zoning Administrator’s notice of violation issued pursuant to a complaint that the appellant’s property at 308 Walnut Street (RPC #51-213-009) contains a lot coverage for all buildings of 26% in violation of Sec. 480-263 of the City Code. The appellants allege the following: 1. “The Zoning Administrator overstepped his authority under the Falls Church City Code in reviewing the Erroneous Notice to issue based on his personal animus and the unwarranted influence of persons having a financial interest in causing damage and distress to us, and not upon any colorable claim of a violation of the City Code, and 2. The Zoning Administrator overstepped his authority under the Falls Church City Code in reviewing construction approved by his office more than five years prior to the ‘investigation’ of the matters at issue herein, and 3. With reference to the table included in the Erroneous Notice the Zoning Administrator made the following errors or omissions in the computation of the asserted ‘building coverage’ of our property: a) Item E is not a ‘building’ under the Falls Church City Code. b) Item H is measured incorrectly. c) Item J is included in error. A children’s play structure with swings and a slide and a rock climbing wall is not a ‘building’ simply because it has a covered platform between the play elements. d) Items A, G, and I are unclear under the Code; the side stoop and rear walkout are not counted.” Information on the above items is available in the Zoning Division, City Hall, West Wing 301, 300 Park Avenue, Falls Church, VA. |
