PUBLIC NOTICE

The Board of Zoning Appeals of the City of Falls Church, Virginia will hold a public hearing on October 14, 2010 at 7:30 p.m. in the Council Chambers, 300 Park Avenue, for consideration of the following subjects: Two items continued from the September 16, 2010 BZA Meeting: Appeal Application A1507-10 (MUNIS #20100567) by Daniel K. Maller v. The City of Falls Church, appealing the Zoning Administrator’s approval of Grading Plan #257 at 1005 Lincoln Avenue, Lots 45 & 46 Block N (RPC # 51-215-054 of the Real Property Identification Map), zoned R-1B Medium Density Residential in the City of Falls Church, because (a) The two lots in question have been, could and can reasonably be combined to meet the minimum size requirements, and therefore the allowance of a side setback less than ten (10) feet is not allowable under any applicable exception to the City of Falls Church Code. (b) Other City administrative officials erred in approving Grading Plan #257 because the two lots in question have been, could and can reasonably be combined to meet the minimum size requirements, and therefore the allowance of a side setback less than ten (10) feet is not allowable under any applicable exception to the City of Falls Church Code. (c) Alternatively, if separate development of Lot 45 is allowed, the proposed single family dwelling exceeds the building coverage limitation of the City of Falls Church Code. Appeal Application A1505-10 (MUNIS #20100481) by Mellon, Middlebrook, Northcutt, Jepson, Corbino & Knodt v. The City of Falls Church, appealing the Zoning Administrator’s approval of Building Permit #20100254 on the basis that: (a) the building permit allows a front yard setback in violation of Section #48-1102(c); (b) that the permit was issued without regard to the averaging required by 48-1102(c); and (c) that the City of Falls Church has previously agreed to utilize averaging, On premises known as 217 Forest Drive, Lot 47, Section 3 (RPC # 53-206-045 of the Real Property Identification Map), zoned R-1A Low Density Residential in the City of Falls Church. New Business: Special Use Permit (Renewal) Application #U1508-10 for the Winter Emergency Homeless Shelter at 217 Gordon Road (renewal) (MUNIS # 20100595) by Rev. Joanne Maughlin, for Friends of Falls Church Shelter, and Wyatt Shields, City Manager of the City of Falls Church, for a special use permit for a homeless shelter to be operated at 217 Gordon Road (Lots 20,21,22 and 23 ((2)) Section 3), RPC #s 52-102-034, 52-102-036 & 52-102-054 of the Falls Church Real Property Identification Map Zoned M-1 (Light Industrial). Note: This is a renewal of an existing special use permit. The Planning Commission considered this item on September 20, 2010 for purposes of making a recommendation to the Board of Zoning Appeals. Appeal Application A1510-10 (MUNIS #20100659) by John D. Lawrence v. The City of Falls Church, appealing the Zoning Administrator’s approval of Building Permit #20100058 on the basis that the permit allows a rear yard setback in violation of Section 48-238(3)(a) on premises known as 611 Oak Haven Drive, Lot 1 of Rohmann’s Addition, zoned R-1A Low Density Residential, RPC #51-121-045.
