Attorneys representing an Arlington man who suffered a traumatic brain injury following an encounter with federal immigration officers are calling for a criminal investigation into the ICE officers involved, according to a statement provided to the Falls Church News-Press Thursday.

José Mejía Hernandez and his attorneys are scheduled to appear at Arlington County Police Department headquarters at 10 a.m. Friday, Aug. 28, where Mejía Hernandez plans to personally file a police report identifying himself as the victim of an alleged crime.

His attorneys, Gastélum Law, APC and The Jurado Firm, say they will present what they describe as newly obtained evidence concerning the Immigration and Customs Enforcement officers involved in the Aug. 11 encounter.

The legal team says it will formally ask local, state and federal authorities to investigate the officers’ conduct and will also seek U-Visa certification under Virginia law based on Mejía Hernandez’s status as an alleged crime victim cooperating with law enforcement.

According to his attorneys, Mejía Hernandez was walking alone to a bus stop in Arlington on the morning of Aug. 11 when he encountered ICE officers. His attorneys allege that he subsequently suffered blunt-force trauma to his head and upper torso, resulting in bleeding and swelling of the brain as well as injuries to his face and upper body.

The Department of Homeland Security has disputed Mejía Hernandez’s account of the encounter, maintaining that its officers rendered aid and transported him to a hospital as a precaution.

Friday’s action will provide additional information about the disputed encounter. Mejía Hernandez’s attorneys say the evidence they intend to provide to Arlington police implicates the ICE officers involved, though the contents of that evidence were not detailed in the statement provided to the News-Press.

The press conference and filing are scheduled for 10 a.m. Friday at Arlington County Police Department Headquarters, Arlington County Justice Center, 1425 N. Courthouse Road, Arlington.
