Judge Continues One Item of Smerdon Suit Vs. F.C. Schools

One aspect of a suit filed by parents of students in the Falls Church City School system, led by former School Board candidate and chair of the Special Education Advisory Committee, Becky Smerdon, was continued by Arlington Circuit Court Judge Daniel S. Fiore Thursday, while the rest of the complaint was dismissed. In the words of F.C. School Superintendent Dr. Toni Jones, in a statement to the News-Press following the trial, “Judge Fiore considered and dismissed petitioners; challenges to Policy 5.12 with the exception of one matter which he took under advisement to give the parties an opportunity to try and come to an agreement on some clarifying language. That lone remaining issue has to do with the role of the School Board liaison with respect to the generation of committee minutes or reports. The School Board is hopeful that it will be possible to finalize revised wording on that issue very soon.”

According to a source, the petitioners will appeal the aspects of their case that Judge Fiore dismissed.
