Fairfax Co. Schools File Motion to Dismiss Lawsuit

Attorneys for Fairfax County Public Schools filed a motion to sever and a motion to dismiss the lawsuit brought against them and Bailey’s Elementary School Principal Marie Lemmon late last month. The motion to sever the lawsuit claims that the claims of Rachel Charlton, the former Bailey’s assistant principal now suing the school for disability, gender and religious discrimination, should be tried separately from the three plaintiffs, Shyrone Stith and Yolanda and J.C. Calhoun, who are suing for racial discrimination.

Attorneys for the school system are requesting the case be dismissed both on procedural grounds and a failure to allege actual discrimination by the school system or Lemmon. The defendants requested a court hearing on these motions for Friday, Nov. 21.
