NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS May 26, 2010

Main Street, Suite 300 Richmond, VA 23219 (804) 373-5733 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by CC South Senior Apartments, LP. REQUEST FOR RELEASE OF FUNDS On or about June 11, 2010 the Department of Housing and Community Development (RE) will “Authorize the Virginia Housing Development Authority to” submit a request to the U.S. Department of Housing and Urban Development for the release of TCAP funds the under the 2009 American Recovery and Reinvestment Act, to undertake a project known as City Center South Senior Apartments, for the purpose of developing 66 newly constructed units at 350 S. Washington Street Falls Church, VA 22046. FINDING OF NO SIGNIFICANT IMPACT The Department of Housing and Community Development has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Virginia Housing Development Authority, located at 601 S. Belvidere Street Richmond, Virginia 23220, and may be examined or copied weekdays (9) A.M. to (3) P.M. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Virginia Housing Development Authority. All comments received by June 10, 2010 will be considered by the Department of Housing and Community Development prior to authorizing submission of a request for release of funds. Commenters should specify which Notice they are addressing. RELEASE OF FUNDS The Department of Housing and Community Development certifies to HUD that Bill Shelton in his capacity as Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUDfs approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Virginia Housing Development Authority to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the Department of Housing and Community Development certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Department of Housing and Community Development; (b) the Department of Housing and Community Development has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD, 600 E. Broad Street, Richmond, Virginia 23219-1800, Attention: Mr. Ronnie J. Legette, Sr., Director, Community Planning and Development Division. NOTICE OF PUBLIC HEARING ON PROPOSED RESOLUTION CREATING THE 360 COMMUNITY DEVELOPMENT AUTHORITY
Notice is hereby given that the City Council of the City of Falls Church, Virginia, will hold a public hearing in accordance with Section 15.2-5156A of the Code of Virginia of 1950, as amended, on a resolution (the “Resolution”) creating the 360 Community Development Authority (the “CDA”). The Resolution authorizes the creation of the CDA for the purpose of financing various infrastructure improvements and services to support the development and redevelopment of the commercial business district of the City fronting 360 South Washington Street into a public purpose structure parking garage and transit improvements and establishes certain other details with respect to the CDA. A complete copy of the Resolution and a copy of the Petition to create the CDA are on file in the City Clerkfs office at the address shown below. The public hearing, which may be continued or adjourned, will be held at 7:30 p.m. or as soon thereafter as the matter may be heard on June 28, 2010, in the City Council Chambers 300 Park Avenue, Falls Church, VA.
